This Privacy Policy describes how Padilla Law PLLC, a Texas professional limited liability company doing business under the trade name Lex Padilla™ (“Padilla,” “Firm,” “we,” “us,” or “our”), collects, uses, discloses, retains, and protects personal information. It applies to information collected through Lex.Padilla.Law, any client or prospective-client portal, online forms, email, telephone and text communications, social media pages, marketing activities, and other services that link to this Privacy Policy (collectively, the “Services”).
In this Privacy Policy, “Affiliate” means an entity that controls, is controlled by, or is under common control with the Firm, including LegalMente AI where applicable. This Privacy Policy applies to prospective clients, clients, website visitors, users of LegalMente AI or Para™, business contacts, and other persons who interact with LP or the Services.
Information processed in connection with legal services may also be governed by an engagement agreement, professional-responsibility obligations, court rules, or other applicable law. If this Privacy Policy conflicts with an engagement agreement concerning LP’s handling of client information, the engagement agreement controls to the extent of the conflict. This Privacy Policy does not create an attorney-client relationship or alter any applicable confidentiality or privilege obligations.
We may collect the personal information reasonably necessary to evaluate requests for legal services, conduct conflicts checks, open and administer matters, provide legal services, operate the Services, communicate with you, process payments, comply with law and professional obligations, and manage and market our business and Affiliate services. Depending on how you interact with us, this may include:
If you provide personal information about another person, you represent that you are authorized to provide it for the relevant purpose. Please provide only information reasonably necessary for your request or matter.
We may collect personal information directly from you; from your employer, representatives, colleagues, or authorized users; through LegalMente, Para, and other Services; from clients, prospective clients, witnesses, counterparties, opposing counsel, courts, government agencies, experts, vendors, referral sources, and other persons involved in a matter; from public records, government databases, websites, social media, and other publicly available sources; from Affiliates; and from service providers such as hosting, security, analytics, communications, identity-verification, customer-relationship-management, payment, and document-management providers.
We may use personal information for the following purposes:
If you do not provide information identified as necessary, we may be unable to evaluate or accept a matter, provide requested legal or technology services, create or maintain an account, process a transaction, or respond to your request.
The Firm may use artificial intelligence, machine learning, generative AI, automated drafting, review, extraction, classification, summarization, research, workflow, and similar technologies (“AI Tools”) in connection with intake, LegalMente, Para, document preparation, legal research support, communications, quality control, security, administration, marketing, and delivery of legal services.
AI Tools may be developed internally or provided by service providers and may process information submitted through the Services. When AI Tools are used in a formal legal engagement, LP’s use remains subject to applicable professional obligations, the engagement agreement, and LP’s policies. LP does not use client-confidential information to train a publicly available AI model in a manner that makes the information available to unaffiliated third parties, except with authorization or as otherwise permitted by the applicable engagement agreement and law.
We may use aggregated or deidentified information to test, evaluate, develop, and improve internal systems and Services. De-identified information is not personal information, and we may use, disclose, and license it for any lawful purpose, including research and development, evaluation, and improvement of our AI Tools. We do not attempt to reidentify deidentified information except to test whether deidentification processes function properly or as otherwise permitted by law.
We and our service providers may use cookies, pixels, web beacons, local storage, software development kits, and similar technologies to operate and secure the Services, remember preferences and login status, understand use and performance, troubleshoot, conduct analytics, and support or measure communications and marketing. These technologies may collect device, usage, online activity, and communication-interaction information.
Most browsers allow you to block or delete cookies. Some Services may not function properly if necessary technologies are disabled. Certain browsers transmit “Do Not Track” signals, but there is no uniform standard for responding to them. We may not respond to such signals unless required by law. Where applicable, additional cookie choices may be provided through the Services.
We may disclose personal information to the following recipients for the purposes described in this Privacy Policy:
We do not sell personal information to third parties. In particular, we do not lend, rent, or exchange personal information with unaffiliated third parties for monetary consideration. We may disclose information to Affiliates, including LegalMente AI, for the purposes described in this Privacy Policy, including marketing LP’s or an Affiliate’s services. We may also disclose information to service providers and other recipients as described above; those operational disclosures are not sales of personal information by LP.
Some privacy laws define “sale,” “sharing,” or similar terms more broadly than an exchange for money. Where such a law applies, we will provide any notice or choice required by that law. We do not knowingly sell the personal information of individuals under 18 years of age.
We or our Affiliates may use your contact information to send marketing communications regarding LP, LegalMente AI, or other Affiliate services, as permitted by law. You may opt out of marketing emails by using the unsubscribe link in the message or contacting us at legal@padilla.law. You may opt out of marketing text messages by replying STOP or using another method described in the message.
An opt-out applies to marketing communications and may take a reasonable time to process. It does not prevent LP or its Affiliates from sending nonmarketing communications, including responses to requests, service notices, account messages, legal-matter communications, security notices, billing messages, or other transactional or legally required communications.
Using the Services, submitting information, communicating with Para or LegalMente, connecting with a Firm attorney, or participating in an initial consultation does not by itself create an attorney-client relationship. An attorney-client relationship is formed only after LP completes and clears its conflicts review, LP accepts the matter, and you and LP accept or sign an applicable engagement agreement.
Before formal engagement, do not submit information that is unnecessary to evaluate the potential engagement, and do not submit highly sensitive information unless LP specifically requests it through an approved channel. Information submitted before an engagement may not be protected by the attorney-client privilege. LP will nevertheless handle information in accordance with applicable law and professional obligations concerning prospective clients.
Once LP is formally engaged, LP’s handling of client information is also governed by the engagement agreement, applicable law, and professional obligations concerning confidentiality, privilege, and client files. Nothing in this Privacy Policy authorizes LP to use or disclose client information in a manner prohibited by those obligations.
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to evaluate and provide services, maintain conflicts and client records, comply with legal and professional obligations, administer our business, resolve disputes, enforce agreements, preserve security, and satisfy tax, accounting, insurance, and litigation-hold requirements. Retention periods vary based on the type of information, the relationship, the sensitivity of the information, and applicable requirements.
When information is no longer required, we may delete, anonymize, or securely destroy it in accordance with our practices and applicable law. We may retain aggregated or deidentified information for longer periods where it no longer reasonably identifies an individual.
We use administrative, technical, and physical safeguards designed to protect personal information, which may include access controls, authentication, encryption where appropriate, secure hosting, role-based permissions, logging, backup, and vendor oversight. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for protecting your own devices, accounts, credentials, and communications.
Depending on where you live and subject to applicable exceptions, you may have rights to request access to or confirmation of personal information we process; request correction or deletion; obtain a portable copy; opt out of certain targeted advertising, sales, sharing, or profiling; limit certain uses of sensitive personal information; or appeal a decision concerning a request. You may also have the right not to receive discriminatory treatment for exercising applicable privacy rights.
To submit a privacy request, contact privacy@padilla.law. We may request information needed to verify your identity, authority, and request. Authorized agents may be required to provide proof of authority. We may retain or withhold information where permitted or required by law, including to preserve privilege, confidentiality, conflicts records, legal holds, security, or professional obligations. If LP processes information on behalf of a client, we may direct the request to that client.
California residents may also request, once per calendar year and as provided by California law, information concerning certain disclosures of personal information to third parties for their own direct-marketing purposes. Requests should be sent to privacy@padilla.law and identify “California Direct Marketing Request” in the subject line.
The Firm is based in the United States. We and our service providers may process or store personal information in the United States and other jurisdictions whose data-protection laws may differ and/or be less protective from those where you reside.
The Services may link to or integrate with websites, applications, platforms, plug-ins, or services operated by third parties, such as LegalMente AI. We do not control and are not responsible for their independent privacy, security, or content practices. Their collection and use of information are governed by their own policies and terms.
The Services are not directed to individuals under 18 years of age, and we do not knowingly collect personal information directly from children under 18 through the Services without appropriate authorization. If you believe a child has provided personal information in a manner prohibited by law, contact us so we can take appropriate action.
We may update this Privacy Policy from time to time. The “Last Updated” date indicates when it was most recently revised. Material changes will be posted through the Services, and we will provide additional notice or obtain consent where required by law.
